- Scope of Application
These General Terms and Conditions (GTC) apply to all contracts concluded between Beyond Events by HM (hereinafter referred to as “Agency”) and its clients. The Agency provides services in the field of event management and event marketing in Austria and within the European Union. They apply to private customers (B2C) and business customers (B2B) within the European Union (EU).
- Contract Conclusion
A contract between the Agency and the client is concluded by written confirmation of an offer, by booking, or by signing a contract. Oral agreements are only valid after written confirmation by the Agency.
- Description of Services
The Agency offers the following services:
- Planning, organization, and execution of events
- Event marketing and promotion
- Ticketing and guest management
- General digital marketing, including visual branding, social media marketing, and online advertising
The exact scope of services will be specified individually in the contract.
- Third-Party Services
The Agency is entitled to engage third parties (e.g., service providers, subcontractors, influencers, advertising networks) to fulfill its obligations. The Agency assumes no liability for violations of legal provisions, delays, or defects in the services provided by third parties. The client is aware that third-party providers may have their own terms and conditions, which apply separately.
- Prices and Payment Terms
All prices are in Euros (EUR), excluding the applicable value-added tax. Unless otherwise agreed, the following payment terms apply:
- 50% deposit upon contract conclusion
- 50% remaining payment no later than 7 days before the event
- For last-minute bookings (< 14 days before the event), the full amount is due immediately.
- Cancellation and Withdrawal
Cancellations by the client:
- Up to 30 days before the event: 30% of the agreed total amount, including services already rendered.
- 29 to 14 days before the event: 50% of the agreed total amount, including services already rendered.
- Less than 14 days before the event: 100% of the agreed total amount.
- Services already rendered (e.g., concepts, bookings, marketing actions) will be charged in any case.
Cancellation by the Agency due to force majeure: If the Agency cannot carry out the event due to force majeure (e.g., natural disasters, pandemics, governmental event bans), the client will be offered an alternative date. If no replacement date is agreed upon, a partial refund will be made, with amounts for services already rendered (e.g., concepts, bookings, marketing actions) deducted from the refund.
- Liability and Warranty
The Agency is fully liable for damages resulting from injury to life, body, or health caused by a willful or negligent breach of duty by the Agency or its agents.
Otherwise, the Agency is only liable for damages caused by willful or grossly negligent behavior. Liability for simple negligence is excluded, unless it concerns essential contractual obligations whose fulfillment is necessary for the proper execution of the contract and on whose compliance the client could rely. The Agency is not liable for indirect damages, consequential damages, or loss of profit, unless they are based on willful or grossly negligent behavior.
- Legal Requirements and GDPR
The Agency collects, processes, and stores personal data of the client only in accordance with the legal provisions of the GDPR. Data may only be shared with third parties with the explicit consent of the client or if this is necessary for contract fulfillment.
- The Agency undertakes to carry out all marketing activities in compliance with the GDPR.
- The client is responsible for the legality of the content provided by them (texts, images, videos, customer data).
- The Agency is not liable for legal violations due to unauthorized or protected content provided by the client.
- Jurisdiction and Applicable Law
Austrian law applies. For all disputes arising from or in connection with these GTC, the competent court at the Agency’s registered office in Austria has exclusive jurisdiction. For clients with a registered office outside Austria, it is explicitly agreed that the place of jurisdiction is also at the Agency’s registered office.
- Final Provisions
If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
